Terms of Service

These terms govern your use of Dawn of Irkalla — the game, its servers, this website, and the companion features that go with them — operated by GreenMind Media Inc. ("GreenMind", "we", "us" or "our"). By creating an account, launching the game, or using any part of it, you agree to them. If you do not agree, do not play.
1. These terms and your GreenMind account
Your GreenMind account is one account across every GreenMind product, and it is governed by the GreenMind Terms of Service, which apply to you in addition to these. Where these terms address something specific to Dawn of Irkalla, they govern for this game; the account terms govern everything else, including the account itself.
Where you play through a platform or storefront — Steam, for example — that platform's own terms apply to your dealings with it, and nothing here changes them.
2. Your account and access to the game
You must be old enough to form a binding contract where you live, and at least 13 years old in any case. You are responsible for everything done through your account and for keeping your sign-in credentials secure. One person, one account; do not share an account, sell one, or use anyone else's.
Playing requires a game account linked to your GreenMind account, and may require an account with a third-party platform or online service. If you lose access to a linked account, you may lose access to the progress attached to it.
3. The game servers, and no uptime commitment
Dawn of Irkalla is an online game. It needs our servers, and the services they depend on, to be running before you can play — including for parts of the game you may play alone.
We make no commitment about availability, uptime, latency, matchmaking quality, or performance of any kind, and there is no service level agreement. The servers may be unavailable at any time, for any length of time, with or without notice — for maintenance, for updates, because something has broken, because of something outside our control, or for no stated reason at all. We may take servers down, move them between regions or providers, change or close regions, reset or reduce capacity, and limit the number of players who can connect.
We are not obliged to provide the servers at any particular time, and downtime is not a breach of these terms. Nothing you have paid for, earned or unlocked entitles you to server availability.
4. Retiring the game
We may discontinue Dawn of Irkalla, in whole or in part, at any time and at our sole discretion — including shutting down the game servers permanently and ending the game for everyone. Games reach the end of their lives, and this one will too.
Where we retire the game entirely, we will give reasonable advance notice by the means available to us — a notice on this website, in the game, on our community channels, or on the storefront you bought it from — so that you are not surprised by it. What counts as reasonable is ours to judge in the circumstances, and we may act with shorter notice, or none, where a service we depend on ends, where we are required to act by law, or where continuing would be unsafe or unlawful.
Retiring a game mode, a season, a realm, a region, an event or a feature is not retiring the game, and needs no notice. When the game or a part of it is retired, access to it and to anything in it ends, and we are not obliged to refund, transfer, convert, replace or compensate you for anything you had — virtual items, currency, progress, time or otherwise — except where the law requires it.
5. Virtual items, currency and progress
Cards, items, cosmetics, currency, levels, unlocks and every other thing you accumulate in the game are part of the game, not property. You get a limited, personal, non-exclusive, non-transferable, revocable licence to use them within Dawn of Irkalla, and nothing more. They have no monetary value, no value outside the game, and no cash equivalent.
You may not sell, buy, trade, gift, rent or transfer accounts, items, currency or progress outside the game, or through any means we have not provided, and we may act against accounts on either side of such a trade.
We may add, change, rebalance, re-price, restrict, expire, reset or remove any virtual item, currency or feature at any time, including for reasons of game balance, and doing so is not a taking of anything you own. Where the game offers something for real money, the purchase is for the licence described above, delivered when the transaction completes; any refund is a matter for the storefront you bought it through and its refund policy.
6. How you must behave
You must not, in the game or in any feature attached to it:
- harass, threaten, stalk, defame, impersonate or incite violence against another person;
- use a name, emblem, message or other content that is hateful, sexually explicit, sexualises minors, promotes terrorism or self-harm, or is otherwise unlawful;
- promote hatred against, or dehumanise, people on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity or sexual orientation;
- share another person's private information, or your own you would not want public;
- advertise, solicit, or run any commercial activity through the game;
- infringe anyone's copyright, trademark or other rights.
These rules apply to anything a player can see: names, chat, custom content, deck and realm names, and anything else you can put in front of somebody else.
7. Cheating, exploits and interference
You must not:
- use cheats, trainers, bots, macros, automation, modified clients or third-party software that changes how the game behaves or gives any player an advantage;
- exploit a bug, glitch or error rather than reporting it — knowingly using one to gain items, currency, progress or an advantage is cheating, whoever wrote the bug;
- reverse engineer, decompile, tamper with, or attempt to gain unauthorised access to the game, its servers, its network traffic or another player's account;
- place unreasonable load on the service, interfere with other players' ability to play, or attempt to disrupt or degrade any part of it;
- deliberately lose, throw, boost, collude, or otherwise manipulate matchmaking, rankings, rewards or the economy.
Where we find cheating or exploitation we may remove items, currency or progress obtained by it, roll back or reset an account, remove a ranking or reward, and suspend or terminate the account — for a first occurrence, and without compensation.
8. What you contribute, and moderation
You keep whatever rights you have in the names, messages, images and other content you put into the game. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, display and adapt that content so far as is necessary to operate the game and show it to the players it is meant for.
We may review, moderate, filter, refuse, alter or remove any content, name or message, and may suspend or terminate any account, at our sole discretion — including where we believe these terms have been broken, where we are required to act by law, or where we consider the content harmful to the game or to other players. We may act without prior notice where we judge it necessary, and choosing not to act in one case does not waive our right to act in another. We are not obliged to monitor anything.
If you send us an idea, a suggestion or feedback, we may use it for any purpose without obligation to you.
9. Other players
Dawn of Irkalla puts you in contact with other people. We do not vet players, we do not control what they say or do, and your dealings with them are between you and them. We are not responsible or liable for the conduct of any player — online or off, in the game or anywhere a contact made through it leads — including harassment, offensive content, deception, scams, trades gone wrong, promises of items or accounts, or any loss or harm arising out of an interaction with another player.
Use the reporting and blocking tools where they exist, and tell us about serious conduct so we can act on the account. Acting on a report is moderation of our service; it is not us taking on responsibility for what a player did.
10. The game as it is
The game, the servers and this website are provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement.
Software has bugs, and games crash. We do not warrant that the game will be uninterrupted, secure, error-free, free of defects, compatible with your hardware, or that any defect will be corrected, and we are not liable for crashes, freezes, disconnections, matches lost or interrupted, input or network latency, corrupted saves, or damage to your device or data.
We do not warrant that progress, items, currency, statistics, rankings or any other data will be preserved, restored or recoverable. Data is lost sometimes — through a fault, a rollback, a failed migration, a hardware failure, or a mistake. We may, but are not obliged to, restore anything.
Some jurisdictions do not allow the exclusion of certain warranties. Where that is so, these exclusions apply to the fullest extent permitted, and nothing here limits liability that cannot lawfully be limited.
11. Limitation of liability
To the fullest extent permitted by law, GreenMind Media Inc., its officers, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for any loss of profits, revenue, data, progress, virtual items or currency, goodwill, or opportunity, however caused and on any theory of liability, arising out of or relating to the game, the servers, their unavailability, their discontinuation, or your use of or inability to use any of it.
To the fullest extent permitted by law, our total aggregate liability arising out of or relating to Dawn of Irkalla will not exceed the greater of the total amount you have paid us for it in the twelve months preceding the claim, or fifty Canadian dollars (CA$50).
Some jurisdictions do not allow the limitation of certain damages. Where that is so, these limitations apply to the fullest extent permitted.
12. Suspension and termination
You may stop playing and delete your account at any time. We may suspend or terminate your access to the game at any time, with or without cause and with or without notice, including where we believe you have broken these terms.
When your access ends, so does your licence to everything in clause 5, and we are not obliged to refund or compensate you for it. Clauses 5, 9, 10, 11, 12 and 15 survive termination.
13. Changes to the game
We may change the game at any time and in any respect: add, alter or remove features, modes, content, characters, cards, items and rules; rebalance anything; reset seasons, rankings or progress where a mode is designed for it; and change what hardware or platforms are supported. A game is a thing that keeps changing, and continuing to play is how you accept the version that exists.
14. Changes to these terms
We may change these terms at any time, for any reason, and in any respect, at our sole discretion. Changes take effect when the revised terms are posted at this address, and the effective date above is updated to reflect it.
Where a change is material we will make reasonable efforts to bring it to your attention, and we may require you to accept the revised terms before playing again. Continuing to use the game after a change takes effect means you accept the revised terms. If you do not accept them, stop playing and delete your account.
15. Governing law
These terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. The courts of Saskatchewan have exclusive jurisdiction, and you consent to their jurisdiction and venue.
16. General
If any provision of these terms is found unenforceable, it will be limited or severed to the minimum extent necessary and the remainder will stay in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy and the GreenMind Terms of Service, are the entire agreement between us about Dawn of Irkalla. You may not assign them; we may, in connection with a merger, acquisition or sale of assets.
